3. Use of Photographs by Clients
Photographs delivered to the client through the website or online gallery may be used exclusively for personal purposes, unless otherwise agreed separately.
Without the author's consent, the following is prohibited:
- commercial use of photographs
- transfer of photographs to third parties
- sale, licensing, or any other form of monetization
- modification, retouching, or applying filters that distort the author's style
4. Online Galleries and Downloads
The website may provide access to private online galleries for viewing and downloading photographs.
Access conditions:
- links and passwords are intended for the client only
- the client is responsible for maintaining access security
- sharing links with third parties is at the client's responsibility
Photographs downloaded from the gallery are considered transferred for personal use in accordance with these Terms.
5. Publication of Photographs
The photographer reserves the right to use photographs in portfolio, on the website, and on social media.
If the client does not agree to the publication of photographs, they must notify the photographer before the photo session begins.
In the absence of such notification, it is assumed that the client does not object to publication.
6. Limitation of Liability
The website owner is not responsible for:
- temporary technical failures of the website
- inability to access galleries for reasons beyond the owner's control
- data loss due to actions of third parties or technical malfunctions
7. Changes to Terms
The website owner reserves the right to make changes to these Terms of Use without prior notice. The current version is always available on the website.
8. Gift Card Public Offer
Gift card for a photo session — terms of use
8.1. General provisions
8.1.1. The gift card is a certificate confirming the right of its holder to receive photography services from the photographer.
8.1.2. Purchase of a gift card constitutes full agreement of the buyer and card holder to these terms, as well as agreement with the photographer's shooting and editing style.
8.1.3. The gift card is not a means of payment and cannot be exchanged for cash.
8.2. Validity period
8.2.1. The gift card is valid for 6 months from the date of purchase, unless otherwise specified.
8.2.2. Upon expiry, the card is considered void.
8.2.3. Expired cards are not extended or compensated.
8.3. Use of the card
8.3.1. The gift card can only be used once.
8.3.2. The card is used to pay for the photo session in full or in part.
8.3.3. If the cost of the selected service exceeds the card value, the difference is paid by the card holder.
8.3.4. If the cost of the service is lower than the card value, the remainder is not refunded.
8.4. Booking the shoot
8.4.1. Use of the card is only possible with advance booking of the shoot date.
8.4.2. The shoot date is scheduled depending on the photographer's availability.
8.4.3. It is recommended to book the date no later than 2–4 weeks in advance.
8.5. Rescheduling and cancellation
8.5.1. Rescheduling the shoot date is allowed once with at least 72 hours' notice.
8.5.2. In case of cancellation or rescheduling with less than 72 hours' notice, the gift card is considered used.
8.5.3. In case of unfavorable weather conditions, the photographer has the right to reschedule the shoot.
8.6. Limitations
8.6.1. The gift card does not apply to:
- studio rental
- makeup artist and stylist services
- clothing or prop rental
- special projects and commercial shoots
unless otherwise specified.
8.7. Transfer of the card
8.7.1. The card cannot be transferred to a third party.
8.7.2. The photographer is not responsible for loss, theft, or use of the card by third parties.
8.8. Refunds
8.8.1. The gift card is not subject to refund or exchange for cash.
8.8.2. In case of refusal of the photographer's services, the cost of the card is not compensated.
All terms and conditions posted on the website that are not separately specified in the gift card terms of use also apply to the use of the gift card.
